株式会社ポック（以下「当社」といいます）は、食の制限をお持ちの方が安心して外食でき、制限のない方とも笑顔で食卓／テーブルをともにできる社会の実現を目指して、食の制限に関する情報を公表している飲食店の情報、食の制限に関するイベント情報、および食のパスポート（Japan Food Passport）等のサービスを提供してまいります。当社は、情報およびIT技術を活用しつつ、当社が提供する「WE TABLE」のサービス（以下「本サービス」といいます。）をご利用されるお客様の個人情報を適切に保護し、お客様への継続的な安心と有益な情報をお届けする情報提供プラットフォームを構築してまいります。

POC Inc. ("the Company") aims to realize a society in which people with dietary restrictions can dine out with peace of mind and share the table with those who have no restrictions. To this end, the Company provides services such as information on restaurants that publish information about dietary restrictions, information on events relating to dietary restrictions, and the Food Passport (Japan Food Passport). Utilizing information and IT technology, the Company will appropriately protect the personal information of users ("the User") of the "WE TABLE" service ("the Service") and build an information platform that delivers continued peace of mind and useful information to Users.

ここに当社のプライバシーポリシー（以下「本ポリシー」といいます。）を記載するとともに、本ポリシーを確実に実行いたします。

The Company hereby sets out its Privacy Policy (this "Policy") and will reliably implement it.

※本プライバシーポリシーにおいて「個人情報」「個人データ」「保有個人データ」「個人関連情報」「要配慮個人情報」とは、「個人情報の保護に関する法律」（以下「個人情報保護法」といいます。）に定義されるものを指します。

* In this Policy, "personal information," "personal data," "retained personal data," "personal-related information," and "special-care-required personal information" mean those defined in the Act on the Protection of Personal Information (the "APPI").

当社は、個人情報の取扱いに関する管理体制を確立するとともに、本ポリシーに従って適切かつ慎重に取り扱います。

The Company establishes a management system for the handling of personal information and handles it appropriately and carefully in accordance with this Policy.

当社は、本サービスをご利用いただくお客様から、主として以下のような情報を取得いたします。

The Company acquires mainly the following information from Users of the Service:

①会員登録時にお客様から提供される情報：eメールアドレス、ユーザーネーム、プロフィール画像、SNSアカウント（任意）、食の制限等の情報

(i) Information provided at member registration: email address, username, profile image, SNS account (optional), and information such as dietary restrictions.

②WE TABLE CREW（以下「クルー」といいます。）登録時に提供される情報：前号記載の情報に加えて、氏名、住所、性別、年代、職業、ご本人またはご家族の食の制限に関する情報

(ii) Information provided at WE TABLE CREW (the "Crew") registration: in addition to the information in (i), name, address, gender, age group, occupation, and information about the dietary restrictions of the User or the User's family.

③食のパスポート（Japan Food Passport）の作成・利用に際して取得される情報：ご本人またはご家族等の年代・性別・出身国・使用言語・お名前（ローマ字表記等）等の属性、ならびに食事に関する自己申告情報（アレルギー、セリアック病、不耐症その他の健康・疾患に関する情報、宗教・信条に基づく食の戒律に関する情報、嗜好、任意のメモ等）

(iii) Information acquired in connection with the creation and use of the Food Passport: attributes of the User or their family, such as age group, gender, country of origin, language used, and name (e.g., in Latin script); and self-reported dietary information (information on allergies, celiac disease, intolerances, and other health/medical conditions; information on dietary rules based on religion or belief; preferences; optional notes; etc.).

④本サービスのご利用に際して取得される情報：口コミ情報、アンケート参加の際に取得される情報

(iv) Information acquired through use of the Service: Review information and information acquired when participating in surveys.

⑤本サービスのサイト（以下「本サイト」といいます。）へのアクセスに際して取得される情報：IPアドレス、携帯端末に関する情報、ブラウザ名・バージョン、OS名・バージョン、Cookieやアクセスログ等の情報

(v) Information acquired upon access to the Service's site (the "Site"): IP address, information about mobile devices, browser name and version, OS name and version, and information such as cookies and access logs.

⑥その他：上記目的以外でお客様から個人情報を取得させていただく場合には、あらかじめ取得目的を明確にし、お客様の同意を得たうえで、その目的達成に必要な限度において適法かつ公正な手段を用います。

(vi) Other: Where the Company acquires personal information from the User for purposes other than the above, it will clarify the purpose of acquisition in advance, obtain the User's consent, and use lawful and fair means to the extent necessary to achieve that purpose.

当社が本サービス（特に食のパスポート、クルー登録）において取得する情報には、食物アレルギー・セリアック病・不耐症その他の健康に関する情報、および宗教・信条に基づく食の戒律に関する情報など、個人情報保護法に定める「要配慮個人情報」が含まれることがあります。当社は、これらの健康に関する情報を、食のパスポートの作成時にお客様から取得する明示的な同意（利用規約への同意とは別に取得するもの）に基づいてのみ取得・利用します。お客様は、本サービスの利用、会員・クルー登録、または食のパスポートの作成にあたり本ポリシーに同意し、かつ食のパスポート作成時の当該同意を行った時点で、当社が当該要配慮個人情報を取得・利用することに同意したものとして取り扱わせていただきます。なお、お客様がご自身の意思で食のパスポートを飲食店等に提示される行為は、お客様ご自身による開示であり、当社による第三者提供には該当しません。

The information the Company acquires through the Service (particularly the Food Passport and Crew registration) may include "special-care-required personal information" under the APPI, such as information on food allergies, celiac disease, intolerances, and other health-related information, and information on dietary rules based on religion or belief. The Company acquires and uses such health-related information only on the basis of the User's explicit consent obtained at the time of creating the Food Passport (obtained separately from agreement to the Terms of Service). The User is treated as having consented to the Company's acquisition and use of such special-care-required personal information at the time the User agrees to this Policy in connection with using the Service, registering as a Member or Crew, or creating a Food Passport, and provides that consent at Food Passport creation. The User's act of presenting the Food Passport to a Restaurant or others at their own will is a disclosure by the User and does not constitute provision to a third party by the Company.

当社は、お客様個人を特定できる健康に関する情報（要配慮個人情報）を、広告目的で利用したり、第三者に販売・提供したりすることは一切ありません。ただし、特定の個人を識別できない形に加工した情報（統計データ、匿名加工情報等）については、この限りではありません（5.(9)・9. 参照）。

The Company never uses health-related information that can identify the User (special-care-required personal information) for advertising purposes, and never sells or provides it to third parties. This does not apply, however, to information processed into a form that cannot identify a specific individual (such as statistical data or anonymized information) (see Sections 5(9) and 9).

当社は取得したお客様の個人情報について、以下の目的（以下「利用目的」といいます。）で利用します。

The Company uses the User's personal information it acquires for the following purposes (the "Purposes of Use"):

(1) 本サービスの内容および本サイトをより充実したものにするため (2) 食のパスポートの作成・表示・提示など本サービスを提供するため (3) お客様に、本サービスに関するお知らせ、有益な情報を通知するため、および必要に応じてお客様に連絡をするため (4) お客様やクルーに、景品や謝礼等をお届けするため (5) 使用状況や利用環境等に関する調査をするため (6) 社内における調査および報告（属性の集計・分析等、個人を特定できない様式に限る）を行うため (7) 不正行為の監視・分析・対策等、安心してご利用いただける環境を整備するため (8) 当社および当社の協力企業の商品・サービス・イベント・キャンペーン等に関するお知らせ、広告その他の情報の配信、ならびにこれらに関するマーケティング施策のため。なお、当社は、当該配信を当社において行うものとし、本目的のために協力企業へお客様の個人データを提供するものではありません。また、第4項に定めるとおり、個人を特定できる健康に関する情報を本目的に用いることはありません。 (9) 食に関する市場・需要・トレンドの調査および分析、ならびに特定の個人を識別できない形に加工した情報（統計データ、匿名加工情報等）の作成、および、これらを当社の事業改善・研究開発に用い、または第三者（当社のクライアント等）へ提供するため。本目的における第三者への提供は、個人を特定できない形（統計データまたは匿名加工情報）に限り、生の個人データを提供することはありません。

(1) To enhance the content of the Service and the Site; (2) To provide the Service, including creating, displaying, and presenting the Food Passport; (3) To notify the User of announcements and useful information regarding the Service, and to contact the User as necessary; (4) To deliver prizes, rewards, etc., to Users and the Crew; (5) To conduct surveys on usage and usage environments; (6) To conduct internal research and reporting (limited to forms that cannot identify individuals, such as aggregation and analysis of attributes); (7) To monitor, analyze, and counter fraudulent acts and otherwise maintain an environment for safe use; (8) To distribute announcements, advertisements, and other information regarding the products, services, events, and campaigns of the Company and its partner companies, and to carry out marketing measures related thereto. The Company itself carries out such distribution and does not provide the User's personal data to partner companies for this purpose. As set out in Section 4, identifiable health-related information is never used for this purpose. (9) To research and analyze food-related markets, demand, and trends; to create information processed into a form that cannot identify a specific individual (such as statistical data or anonymized information); and to use these for the Company's business improvement and research and development, or to provide them to third parties (such as the Company's clients). Provision to third parties under this purpose is limited to non-identifiable forms (statistical data or anonymized information); raw personal data is never provided.

お客様は、いつでも当社所定の方法により、前項(8)に基づくお知らせ・広告等の配信の停止（オプトアウト）を求めることができます。

The User may, at any time and by the method prescribed by the Company, request that distribution of announcements, advertisements, etc. under item (8) of the preceding paragraph be stopped (opt out).

本サービスは、利便性の向上と利用状況の把握のためCookie等を使用します。電気通信事業法の外部送信規律に基づき、当社が利用者の端末から外部事業者へ送信する情報の内容を、以下のとおり公表します。

The Service uses cookies and similar technologies to improve usability and understand usage. In accordance with the external-transmission rules of Japan's Telecommunications Business Act, the Company discloses the information it transmits from users' devices to external providers as follows.

※ 食のパスポートに入力された食事制限・健康に関する情報が、外部の解析事業者へ送信されることはありません。

* Dietary and health-related information entered in the Food Passport is never transmitted to external analytics providers.

お客様は、ブラウザ設定によりCookieを無効化できますが、その場合、一部機能（ログイン状態の保持等）がご利用いただけなくなることがあります。Google Analyticsによる収集は、Googleが提供するオプトアウトアドオンにより停止できます。

You may disable cookies through your browser settings, in which case some functions (such as staying logged in) may become unavailable. Collection by Google Analytics can be stopped via the opt-out add-on provided by Google.

当社は、当社の業務委託先に対して機密保持条項などを含む情報セキュリティに関する契約を締結したうえで、委託業務の遂行に必要な範囲に限り、個人情報の取扱いの一部を委託することがあります。これらの業務委託先については、選定基準を設け適切な委託先を選定しており、業務委託先における個人データの取扱い状況について把握するための措置を講じております。また、これらの業務委託先が当社からの受託業務遂行以外の目的で個人情報を利用または提供することは禁止されております。

The Company may entrust part of the handling of personal information to subcontractors, limited to the extent necessary to perform the entrusted work, after concluding contracts on information security including confidentiality clauses. The Company selects appropriate subcontractors based on selection criteria and takes measures to ascertain the status of their handling of personal data. Such subcontractors are prohibited from using or providing personal information for any purpose other than performing the work entrusted by the Company.

(1) 当社は、お客様から取得した個人データを、あらかじめお客様の同意を得ることなく第三者に提供することはありません。ただし、以下のいずれかの場合はこの限りではありません。 ① お客様本人の同意がある場合 ② 法令に基づく場合 ③ お客様の生命、身体または財産の保護のために緊急に必要があると当社が判断した場合 ④ 犯罪捜査のため等、警察、検察、裁判所、弁護士会またはこれに準じた権限を有する機関から開示請求があった場合

(1) The Company will not provide personal data acquired from the User to third parties without obtaining the User's prior consent, except in any of the following cases: (i) where the User consents; (ii) where based on laws and regulations; (iii) where the Company determines it is urgently necessary to protect the life, body, or property of the User; (iv) where a disclosure request is made by the police, prosecutors, a court, a bar association, or an equivalent authority, such as for a criminal investigation.

(2) お客様がご自身の意思で食のパスポートを飲食店等に提示される行為は、お客様ご自身による開示であり、本項の第三者提供には該当しません。

(2) The User's act of presenting the Food Passport to a Restaurant or others at their own will is a disclosure by the User and does not constitute provision to a third party under this Section.

(3) 当社は、お客様の求めに応じて、お客様の個人データの第三者への提供を停止いたします。

(3) Upon the User's request, the Company will cease providing the User's personal data to third parties.

(4) 特定の個人を識別できない形に加工した情報（統計データ、匿名加工情報等）は、特定の個人を識別することができないため、「個人データ」には該当しません。したがって、第5条(9)に基づくこれらの作成・利用および第三者（当社のクライアント等）への提供は、本条(1)の制限の対象外です。なお、当社が匿名加工情報を第三者に提供する場合には、個人情報保護法に従い、提供する情報の項目および提供の方法をあらかじめ公表し、提供先に対して当該情報が匿名加工情報である旨を明示します。

(4) Information processed into a form that cannot identify a specific individual (such as statistical data or anonymized information) does not constitute "personal data," as it cannot identify a specific individual. Accordingly, the creation, use, and provision to third parties (such as the Company's clients) of such information under Section 5(9) are not subject to the restriction in paragraph (1) of this Section. Where the Company provides anonymized information to a third party, it will, in accordance with the APPI, publish in advance the categories of information provided and the method of provision, and will indicate to the recipient that the information is anonymized information.

(5) 当社は、業務委託等に伴い、外国にある第三者に個人データの取扱いを委託することがあります。この場合、当社は、個人情報保護法に基づき、当該第三者が我が国の個人情報取扱事業者に求められる水準に相当する体制（基準適合体制）を整備していることを確認した上で委託し、当該体制の継続的な実施を確保するために必要な措置を講じます。委託先の所在国、当該国の個人情報保護制度に関する情報および当社が講じている措置については、下記12.の窓口までお問い合わせいただければご提供いたします。

(5) In connection with subcontracting and similar arrangements, the Company may entrust the handling of personal data to third parties located outside Japan. In such cases, in accordance with the APPI, the Company entrusts such handling only after confirming that the third party has established a system conforming to the standards required of personal information handling business operators in Japan, and takes the measures necessary to ensure the continued implementation of that system. Information on the countries in which such subcontractors are located, the personal-information protection regimes of those countries, and the measures taken by the Company will be provided upon inquiry to the contact desk in Section 12 below.

お客様は、ご自身に関する保有個人データ等について、個人情報保護法に規定される開示、訂正、追加、削除、利用停止、消去または第三者提供の停止、ならびに利用目的の通知を請求することができます。ご請求は下記12.の窓口までお申し出ください。当社は、ご本人（または法定代理人）であることを確認の上、法令に定める期間内に対応いたします。開示のご請求に際して手数料をいただく場合には、実費の範囲内といたします。なお、お客様が本サービスの会員を退会された場合、当社は、保有個人データ等（保存された食のパスポートおよびお客様を特定できる健康に関する情報を含みます。）を、遅滞なく削除し、又は特定の個人を識別できない形に加工いたします。特定の個人を識別できない形に加工した情報については、削除の対象外とし、当社は5.（個人情報の利用目的）の範囲で引き続き利用することがあります。当社が匿名加工情報を作成・利用する場合には、個人情報保護法の定めに従い、当該情報に含まれる個人に関する情報の項目を公表し、本人を再識別する目的で他の情報と照合することはいたしません。

The User may request, with respect to their retained personal data, the disclosure, correction, addition, deletion, suspension of use, erasure, or suspension of third-party provision, as well as notification of the purpose of use, as provided under the APPI. Requests should be directed to the contact desk in Section 12 below. The Company will respond within the period prescribed by law after verifying that the requester is the User (or their legal representative). Any fee charged for a disclosure request will not exceed actual costs. If the User withdraws their membership of the Service, the Company will, without undue delay, delete or process into a form that cannot identify a specific individual the retained personal data (including the saved Food Passport and health-related information that can identify the User). Information processed into a form that cannot identify a specific individual is not subject to deletion, and the Company may continue to use it within the scope of the purposes set out in Section 5. Where the Company creates and uses anonymized information, it will, in accordance with the APPI, publish the categories of information about individuals contained therein and will not collate it with other information for the purpose of re-identifying the individual.

(1) 当社は、目的外利用等の不適切な取扱いを防ぐため、以下のような安全管理措置を講じ、個人情報への不正アクセスまたは個人情報の紛失、破壊、改ざん、漏えい等を防止いたします。 1. 個人データの取扱いに関する責任者を設置する。 2. 個人データを取り扱う従業員および当該従業員が取り扱う個人データの範囲を明確化し、個人情報保護法や個人データの取扱いに関する社内規程に違反している事実または兆候を把握した場合の責任者への報告連絡体制を整備する。 3. 個人データの取扱いに関する留意事項について、従業員に教育・周知を行う。 4. アクセス制限を実施して、担当者および取り扱う個人情報データベース等の範囲を限定し、アクセス権限を有しない者による個人データの閲覧を防止する措置を実施する。 5. 通信の暗号化その他の技術的な安全管理措置を実施する。

(1) To prevent inappropriate handling such as use beyond the stated purposes, the Company takes security control measures such as the following and prevents unauthorized access to, and loss, destruction, alteration, or leakage of, personal information: 1. Appointing a person responsible for the handling of personal data; 2. Clarifying which employees handle personal data and the scope of personal data they handle, and establishing a reporting system to the responsible person upon detecting any fact or sign of a violation of the APPI or internal rules on the handling of personal data; 3. Providing training and awareness to employees on points of caution regarding the handling of personal data; 4. Implementing access restrictions to limit the personnel and the scope of personal information databases handled, and measures to prevent viewing of personal data by persons without access rights; 5. Implementing technical security measures such as encrypted communications.

(2) 当社が個人データの取扱いを第三者に委託する場合は、当社が定める委託先選定基準を満たす者に委託し、委託先と契約を締結して委託先による業務を適切に管理しています。

(2) Where the Company entrusts the handling of personal data to a third party, it entrusts only parties meeting the Company's subcontractor selection criteria, concludes a contract with the subcontractor, and appropriately manages the subcontractor's work.

(3) 個人データは、当社が契約するクラウド基盤および業務委託先のサービス上で管理します。これらのサーバーの一部は、米国その他の日本国外に所在します。当社は、外的環境の把握として、当該所在国における個人情報保護制度を確認した上で、必要かつ適切な安全管理措置を講じます。個人データが保存される国の詳細は、下記12.の窓口までお問い合わせいただければご回答いたします。

(3) Personal data is managed on cloud infrastructure contracted by the Company and on the services of its subcontractors. Some of these servers are located outside Japan, including in the United States. As part of ascertaining the external environment, the Company confirms the personal-information protection regime of the countries in which the data is located and implements necessary and appropriate security control measures. Details of the countries in which personal data is stored will be provided upon inquiry to the contact desk in Section 12 below.

当社は、確実な個人情報保護の実現のために、個人情報保護法、電気通信事業法その他の個人情報関連法令を遵守いたします。本ポリシーを改定する場合は本サービス上で告知し、健康に関する情報の取扱いに関わる重要な変更については、再同意を取得いたします。

To ensure the reliable protection of personal information, the Company complies with the APPI, the Telecommunications Business Act, and other laws and regulations concerning personal information. Where this Policy is amended, the Company will announce it on the Service, and for material changes affecting the handling of health-related information, the Company will obtain renewed consent.
