WE TABLE ご利用規約 / WE TABLE Terms of Service

１.私たちは、食の制限をお持ちの方が安心して外食でき、制限のない方とも笑顔で食卓／テーブルをともにできる社会の実現に貢献したいと考えています。WE TABLE では、食の制限に関する情報を公表している飲食店（以下「飲食店」といいます。）の情報（以下「飲食店情報」といいます。）、お客様から投稿されたコメント・画像等の情報（以下総称して「口コミ」といいます。）、食の制限に関するイベント情報（以下「イベント情報」といいます。）、お客様ご自身の食事に関する事情を飲食店等に伝えるための「食のパスポート」（Japan Food Passport）、およびお客様同士のコミュニティの場を提供してまいります。

1. We aim to contribute to a society in which people with dietary restrictions can dine out with peace of mind and share the table with those who have no restrictions. Through WE TABLE, we provide: information on restaurants that publish information about dietary restrictions ("Restaurants"; such information, "Restaurant Information"); comments, images, and other information posted by Users (collectively, "Reviews"); information on events relating to dietary restrictions ("Event Information"); the "Food Passport" (Japan Food Passport), which helps the User communicate their own dietary circumstances to Restaurants and others; and a community space for Users.

２.WE TABLE の飲食店情報およびイベント情報は、現在、原則として東京都内のものとし、対象エリアは順次拡大してまいります。これらは予告なく変更する可能性がございます。

2. Restaurant Information and Event Information on WE TABLE currently cover, in principle, areas within Tokyo, and the covered areas will be expanded over time. These may be changed without prior notice.

３.WE TABLE は、お客様と飲食店等との間の意思疎通を補助し、お店探しを支援することを目的とするものであり、提供される飲食物の安全性を保証する仕組みではありません。最終的な確認と判断は、お客様ご自身の責任において行っていただきます（詳細は第9条をご参照ください）。

3. WE TABLE is intended to assist communication between the User and Restaurants and to support the search for restaurants. It is not a mechanism that guarantees the safety of any food or beverage provided. Final confirmation and judgment must be made by the User at the User's own responsibility (see Article 9 for details).

１.お客様は、当社所定の手続に従い、WE TABLE の会員登録を行うことができます。WE TABLE は会員登録をすることなくご利用いただけますが、一部のサービス（食のパスポートの保存を含みます。）については、会員登録が完了したお客様（以下「会員」といいます。）のみがご利用できます。食のパスポートの作成・表示は、会員登録をすることなくご利用いただけます。当社は、会員登録を完了していないお客様がご利用できるサービスの範囲を任意に決定し、または随時変更できるものとします。

1. The User may register as a member of WE TABLE in accordance with the procedures prescribed by the Company. WE TABLE may be used without member registration; however, certain services (including saving a Food Passport) are available only to Users who have completed member registration ("Members"). Creating and displaying a Food Passport is available without member registration. The Company may freely determine, and change from time to time, the scope of services available to Users who have not completed member registration.

２.会員のうち、当社所定の手続により承認を受けた方を「WE TABLE CREW」（以下「クルー」といいます。）といいます。飲食店情報および口コミの投稿は、クルーのみが行うことができます。当社は、クルーの登録要件および投稿できる範囲を任意に定め、または随時変更できるものとします。

2. Members who have been approved through the Company's prescribed procedures are referred to as "WE TABLE CREW" (the "Crew"). Only the Crew may post Restaurant Information and Reviews. The Company may freely determine, and change from time to time, the eligibility requirements for the Crew and the scope of permitted posting.

３.未成年のお客様は、親権者その他の法定代理人の同意を得た上で WE TABLE を利用するものとします。

3. Minors shall use WE TABLE only after obtaining the consent of a parent or other legal guardian.

１.お客様は、WE TABLE にログインするためのログインIDおよびパスワード（以下併せて「ログインアカウント等」といいます。）の登録・使用・管理等をご自身の責任において行うものとします。なお、WE TABLE のログインアカウント等は、マップ、イベント、食のパスポートその他の WE TABLE の各サービスに共通で用いられます。

1. The User shall register, use, and manage the login ID and password used to log in to WE TABLE (collectively, "Login Credentials") at the User's own responsibility. The Login Credentials for WE TABLE are used in common across the MAP, Event, Food Passport, and other services of WE TABLE.

２.お客様の故意、過失を問わず、ログインアカウント等を使用してログインされて行われた WE TABLE における一切の行為については、当該お客様ご自身によって行われた行為とみなし、当該行為に関する一切の責任は当該お客様が負担するものとします。

2. Regardless of whether due to the User's intent or negligence, any and all acts performed on WE TABLE through a login using the Login Credentials shall be deemed acts performed by that User, and that User shall bear all responsibility for such acts.

１.「マップ」サービス：お客様は、WE TABLE のマップ上で飲食店情報および当該飲食店に係る口コミを閲覧することができます。なお、飲食店情報および口コミの投稿は、クルーのみが行うことができます。

1. "MAP" service: The User may view Restaurant Information and Reviews relating to Restaurants on the WE TABLE map. Restaurant Information and Reviews may be posted only by the Crew.

２.「イベント」サービス：お客様は、食の制限にフレンドリーなイベント等の情報を閲覧することができます。

2. "Event" service: The User may view information on events that are friendly to dietary restrictions.

３.「食のパスポート」（Japan Food Passport）サービス：お客様は、ご自身（またはご家族等）の食事に関する事情を入力し、飲食店等の第三者に提示するための情報表示物（以下「食のパスポート」といいます。）を作成・表示することができます。デジタル版の食のパスポートの作成・利用は無料です。本サービスの性質および利用上の注意は、第9条に定めるところによります。

3. "Food Passport" (Japan Food Passport) service: The User may enter dietary circumstances of the User (or the User's family, etc.) and create and display an information item ("Food Passport") to present to Restaurants and other third parties. Creating and using the digital Food Passport is free of charge. The nature of this service and the precautions for its use are as set out in Article 9.

４.「PDF版」：当社は、食のパスポートの内容を印刷用に整えたカテゴリ別のPDF（以下「PDF版」といいます。）を、Etsy等の外部プラットフォームを通じて有償で販売することがあります。当該取引には、各外部プラットフォームの規約および当社の「特定商取引法に基づく表記」が適用されます。外部プラットフォームへ遷移した後の取引・決済・配信は、当該プラットフォームの提供する仕組みに基づきます。PDF版についても第9条の定めが同様に適用されます。

4. "PDF Edition": The Company may sell, for a fee through external platforms such as Etsy, category-based printable PDFs of the Food Passport content (the "PDF Edition"). Such transactions are governed by the terms of each external platform and by the Company's Specified Commercial Transactions Act disclosure. Transactions, payment, and delivery after leaving for an external platform are handled by that platform's systems. Article 9 applies equally to the PDF Edition.

１.お客様は、WE TABLE のご利用にあたり、お客様ご自身とお客様の関連会社・関係者が、暴力団、暴力団構成員、暴力団関係企業もしくは関係者、総会屋、その他の反社会的勢力ではないことを保証するものとします。

1. In using WE TABLE, the User represents and warrants that the User and the User's affiliates and related parties are not organized crime groups, members of organized crime groups, companies or persons affiliated with organized crime groups, corporate racketeers (sokaiya), or any other anti-social forces.

２.お客様は、WE TABLE について、その全部あるいは一部を問わず、営業活動その他の営利を目的とした行為またはそれに準ずる行為を目的として、利用またはアクセスしてはならないものとします。また、宗教活動、政治活動等の目的での利用またはアクセスも行ってはならないものとします。

2. The User shall not use or access WE TABLE, in whole or in part, for the purpose of sales activities or other for-profit or quasi-for-profit activities. The User shall also not use or access WE TABLE for the purpose of religious or political activities and the like.

３.WE TABLE へ投稿された口コミは、当該投稿をしたお客様ご本人を除き、無断転載・無断利用することを禁止します。

3. Except by the User who posted them, unauthorized reproduction or use of Reviews posted to WE TABLE is prohibited.

４.口コミを投稿したお客様ご本人による当該口コミのご利用等、本規約が特に認めた場合を除き、WE TABLE に掲載されている口コミを利用して利益を得た場合には、当社はその利益相当額の金員を請求できる権利を有するものとします。

4. Except as specifically permitted by these Terms (such as use of a Review by the User who posted it), if any party obtains a profit by using Reviews posted on WE TABLE, the Company shall have the right to claim an amount equivalent to such profit.

１.当社は、提供する WE TABLE を当社の都合により、またはより良いサービスに改善するために変更することがございます。

1. The Company may change WE TABLE at its own discretion or in order to improve the service.

２.当社は、WE TABLE が以下に該当したときは、お客様への事前の通知・予告なしに一時的に WE TABLE の提供を中断させていただく場合があります。これによりお客様が損害を被っても、当社は第10条に定める範囲を超えて賠償責任を負いません。

2. The Company may temporarily suspend the provision of WE TABLE without prior notice to the User in any of the following cases. Even if the User suffers damage as a result, the Company shall not be liable beyond the scope set out in Article 10.

①WE TABLE の端末機器の障害、保守またはメンテナンスを緊急で行う必要があるとき。 ②天災地変、自然災害、停電等もしくは電気通信事業者の回線障害等によるオンラインシステムの中断・機能不全。 ③その他、WE TABLE の運営・管理上または技術上やむを得ず一時中断もしくは事故、その他緊急事態が生じたとき。

(i) When there is a need to urgently address a failure of WE TABLE's equipment, or to perform maintenance. (ii) Interruption or malfunction of the online system due to acts of God, natural disasters, power outages, or line failures of telecommunications carriers, etc. (iii) Any other case where a temporary interruption is unavoidable for operational, administrative, or technical reasons, or where an accident or other emergency arises.

お客様が WE TABLE をご利用になるために必要な機器・ソフトウェア・通信環境等は、お客様自らの責任と費用で適切にご準備・操作していただく必要があり、WE TABLE にアクセスする通信費用もお客様のご負担となります。

The User must appropriately prepare and operate, at the User's own responsibility and expense, the devices, software, communication environment, and the like necessary to use WE TABLE. Communication costs for accessing WE TABLE shall also be borne by the User.

１.WE TABLE に口コミ投稿を行うには、クルーの登録が必要となります。

1. Registration as a Crew member is required in order to post Reviews to WE TABLE.

２.クルーは、口コミの投稿にあたり、次の事項を遵守するものとします。①実際の体験に基づき、できる限り正確かつ公平な内容とすること。②アレルギー症状や安全性に関して誤解を招く情報を投稿せず、また「絶対に安全」等、安全を断定する表現を用いないこと。③他のお客様、店舗スタッフその他の者の個人情報やプライバシーを侵害しないこと。④第三者の権利を侵害せず、公序良俗に反しないこと。当社は、これらの遵守事項に関する細目を別途お知らせすることがあり、その場合、クルーはこれにも従うものとします。

2. When posting Reviews, the Crew member shall comply with the following: (i) make the content as accurate and fair as possible, based on actual experience; (ii) not post information that is misleading as to allergic symptoms or safety, and not use expressions that assert safety, such as "absolutely safe"; (iii) not infringe the personal information or privacy of other customers, restaurant staff, or any other person; and (iv) not infringe the rights of third parties or act contrary to public order and morals. The Company may separately notify Crew members of details regarding these compliance matters, in which case the Crew member shall also comply with them.

３.クルーが口コミ（文章、写真、画像、動画その他一切のコンテンツを含みます。）の投稿を行った時点で、クルーは当社に対し、当該口コミを、国内外において、無償で、地域・期間・回数・媒体の制限なく（当該著作権の存続期間が満了するまで）、複製、公衆送信、頒布、翻訳・翻案、改変その他の方法により利用する権利、および第三者に対して再許諾（サブライセンス）する権利を、撤回不能なものとして許諾したものとします。著作権はクルーに留保されますが、本許諾は本条の定めるところにより存続します。

3. At the time a Crew member posts a Review (including text, photographs, images, videos, and any and all other content), the Crew member grants the Company an irrevocable license to use such Review—in Japan and abroad, free of charge, without restriction as to region, period, number of uses, or medium (until the expiration of the term of copyright)—including by reproduction, public transmission, distribution, translation, adaptation, and modification, as well as the right to sublicense to third parties. Copyright remains with the Crew member, but this license survives as provided in this Article.

４.クルーは、当社および当社が指定する第三者に対し、当該口コミに係る著作者人格権を行使しないものとします。

4. The Crew member shall not exercise any moral rights (author's personal rights) in such Review against the Company or any third party designated by the Company.

５.クルーは、投稿する口コミについて、第三者の著作権その他の権利を侵害していないこと、および前二項の許諾および不行使を行うために必要な正当な権利を有していることを保証するものとします。第三者の著作物等を利用して投稿を行う場合には、クルーの責任と負担において必要な権利処理がなされていることを前提とさせていただきますので、十分に注意して投稿を行ってください。

5. The Crew member warrants that the Review they post does not infringe the copyrights or other rights of any third party, and that they hold the legitimate rights necessary to grant the license and undertake the non-exercise in the preceding two paragraphs. Where a posting uses a third party's work, it is assumed that the necessary rights clearance has been completed at the Crew member's responsibility and expense; please post with due care.

６.当社（もしくは当社から再許諾を受けた第三者）は、その判断において口コミを利用することができます。この際、口コミの一部を要約・抜粋したり、投稿された写真（画像）のサイズ変更・切り抜きを行うなど一部改変等する場合があります。また、口コミを利用する場合に、投稿時のユーザーネームを表示する場合があります。本許諾には、地域制限、著作権表示義務その他の付随条件はなく、ロイヤリティその他の対価は一切発生しないものとします。

6. The Company (or a third party sublicensed by the Company) may use Reviews at its discretion. In doing so, the Company may make partial modifications, such as summarizing or excerpting Reviews, or resizing or cropping posted photographs (images). When using a Review, the Company may display the username used at the time of posting. This license is subject to no territorial restriction, copyright notice obligation, or other ancillary conditions, and no royalties or other consideration shall accrue.

７.本条に基づく利用許諾は、クルーの退会、会員資格の喪失または本規約に基づく契約の終了の後も存続するものとし、撤回または解除することはできません。クルーは、退会その他の事由により本サービスの利用を終了した後においても、既に投稿した口コミの削除または利用の停止を当社に請求することはできないものとします。なお、当社は、その裁量により、いつでも当該口コミを削除することができます。

7. The license under this Article shall survive the Crew member's withdrawal, loss of membership, or termination of the contract under these Terms, and may not be revoked or rescinded. Even after the Crew member ends their use of the Service due to withdrawal or any other reason, the Crew member may not request the Company to delete or cease using Reviews already posted. The Company may, however, delete such Reviews at its discretion at any time.

８.当社または第三者が口コミを利用したことによってクルーまたは第三者が受けた損害について、当社の過失による債務不履行責任または不法行為責任が認められる場合のみ、当社は通常生ずべき損害（逸失利益その他特別の事情によって生じた損害を除きます）の範囲内でのみ損害賠償責任を負うものとします。

8. With respect to damage incurred by a Crew member or a third party as a result of the Company's or a third party's use of Reviews, the Company shall be liable for damages only where liability for default (breach of contract) or in tort due to the Company's negligence is established, and only within the scope of ordinary damages that would normally arise (excluding lost profits and other damages arising from special circumstances).

本条は、誤った飲食物の摂取による事故等を防ぐための最も重要な定めです。お客様は、食のパスポートを利用される前に必ずご理解ください。

This Article is the most important provision for preventing accidents caused by consuming the wrong food or beverage. The User must read and understand it before using the Food Passport.

１.食のパスポートは、お客様が自らの食事に関する事情を飲食店等の第三者に伝えることを補助するためのコミュニケーション・ツールです。料理や飲食物の安全性、適合性、無害性を保証するものでは一切ありません。当社は、次のいずれについても保証いたしません。

1. The Food Passport is a communication tool that assists the User in conveying their own dietary circumstances to Restaurants and other third parties. It does not in any way guarantee the safety, suitability, or harmlessness of any dish or food or beverage. The Company makes no warranty as to any of the following:

①お客様が摂取する飲食物が、お客様のアレルギー・疾患・戒律・嗜好等に適合していること。 ②飲食店等が食のパスポートの内容を正しく理解し、または適切に対応すること。 ③飲食物にアレルゲン・特定成分等が混入していないこと。 ④表示・翻訳された文言が、お客様の意図どおりに第三者へ伝わること。

(i) that the food or beverage the User consumes is compatible with the User's allergies, medical conditions, religious rules, preferences, etc.; (ii) that Restaurants or others will correctly understand, or appropriately respond to, the contents of the Food Passport; (iii) that the food or beverage is free of allergens or particular ingredients; (iv) that the displayed or translated wording will be conveyed to third parties as the User intends.

２.食のパスポートで用いられる文言・表現・翻訳・分類等は、言語による伝達である以上、本質的に限界があります。同一の表現であっても受け手によって理解が異なり得るものであり、すべての方が同一の意味に理解することを当社は保証しません。これらの表現は、サービス向上のため日々更新・変更されることがあり、「唯一の正解」は存在しません。

2. The wording, expressions, translations, and classifications used in the Food Passport are inherently limited, as they are communication through language. The same expression may be understood differently by different recipients, and the Company does not guarantee that everyone will understand it in the same way. These expressions may be updated and changed from time to time for the purpose of improving the service, and there is no single "correct answer."

３.お客様は、飲食物を摂取される前に、ご自身の責任において、飲食店等に対し直接かつ十分に内容を確認していただく必要があります。食のパスポートの提示は、この確認に代わるものではなく、これを補助するにすぎません。最終的な摂取の可否のご判断は、常にお客様ご自身の責任において行っていただきます。

3. Before consuming any food or beverage, the User must, at the User's own responsibility, confirm the details directly and sufficiently with the Restaurant or others. Presenting the Food Passport does not replace such confirmation but merely assists it. The final decision on whether to consume is always made by the User at the User's own responsibility.

４.アレルギー、セリアック病、アナフィラキシーその他、誤った飲食物の摂取により生命または身体に重大な危険が生じ得る事情をお持ちのお客様は、食のパスポートの表示のみに依拠することなく、飲食のたびに飲食店等へ直接ご確認ください。当社は、これらのお客様に対し、緊急時の備え（処方されている場合の緊急用医薬品の携行等）の確認、およびご自身の費用とご判断による各種保険（旅行保険・医療保険等）へのご加入を強く推奨いたします。アレルギー症状等の緊急時には、直ちに医療機関を受診し、または救急（日本では119）へご連絡ください。

4. Users who have conditions under which consuming the wrong food or beverage could pose a serious risk to life or body—such as allergies, celiac disease, or anaphylaxis—must not rely solely on the display of the Food Passport, and must confirm directly with the Restaurant or others on every occasion of eating or drinking. The Company strongly recommends that such Users confirm their emergency preparations (such as carrying prescribed emergency medication, if any) and, at their own expense and judgment, obtain appropriate insurance (such as travel insurance or medical insurance). In an emergency such as an allergic reaction, seek medical care immediately or call emergency services (119 in Japan).

５.お客様が食のパスポートの利用に関して当社に料金をお支払いいただいた場合（PDF版の購入を含みます。）であっても、当該料金はコミュニケーション補助ツールおよび情報・キュレーションの提供に対する対価であり、飲食物の安全性・適合性を保証する対価ではありません。本条および第10条の定めは、食のパスポートが有料か無料かを問わず、同様に適用されます。

5. Even if the User pays the Company a fee in connection with use of the Food Passport (including the purchase of the PDF Edition), such fee is consideration for the provision of a communication-support tool and information/curation, and is not consideration for guaranteeing the safety or suitability of food or beverages. The provisions of this Article and of Article 10 apply equally regardless of whether the Food Passport is paid or free.

WE TABLE は、お客様ご自身の責任においてご利用いただきます。また、以下の各号につき予めご了承いただくものとします。

WE TABLE is used at the User's own responsibility. The User acknowledges and agrees in advance to each of the following.

（賠償責任の範囲および上限） 本条その他本規約に基づき、または本サービスの利用に関連して当社がお客様に対して損害賠償責任を負う場合であっても、当社が賠償する損害は、当社の行為に直接起因してお客様に現実に生じた通常の損害に限られ、逸失利益、機会の損失（機会損失）、事業上の損害、データの損失、その他の特別損害・間接損害・結果的損害を一切含まないものとします。また、当社が賠償する金額は、当該損害の原因となった事由が生じた時点からさかのぼって過去12か月の間にお客様が当社に対して現に支払った当該サービス（食のパスポートおよびPDF版の利用料金等を含みます。）の利用料金の総額を上限とします。ただし、当社の故意または重大な過失による場合には、本項は適用されません。

(Scope and Cap of Liability for Damages) Even where the Company bears liability to the User for damages under this Article or otherwise under these Terms, or in connection with use of the service, the damages the Company compensates shall be limited to ordinary damages actually incurred by the User directly arising from the Company's act, and shall not include any lost profits, loss of opportunity, business damages, loss of data, or any other special, indirect, or consequential damages. Furthermore, the amount the Company compensates shall be capped at the total amount of fees for the relevant service (including, without limitation, fees for the Food Passport and PDF Edition) actually paid by the User to the Company during the 12 months preceding the event giving rise to the damage. However, this paragraph does not apply in the case of the Company's willful misconduct or gross negligence.

（1）飲食店および飲食店の食の制限に関する情報 当社は、飲食店情報については最新の情報を掲載するよう努め、随時更新いたします。ただし、当社は、飲食店情報その他の掲載情報に関して、安全性、完全性、正確性、最新性、有用性、合目的性等についていかなる保証もいたしません。掲載された飲食店をご利用される際には、事前に電話等の方法によりお客様ご自身で直接飲食店に確認されることを強く推奨いたします。掲載された飲食店情報によってお客様に生じた損害や、お客様同士のトラブル等について、当社の過失による債務不履行責任または不法行為責任が認められる場合のみ、当社は通常生ずべき実質損害（逸失利益その他特別の事情によって生じた損害を除きます）の範囲内でのみ損害賠償責任を負うものとします。掲載された飲食店情報が正しくない場合はこちらへご連絡ください。

(1) Restaurants and Restaurant Information on Dietary Restrictions The Company endeavors to post the latest Restaurant Information and updates it from time to time. However, the Company makes no warranty whatsoever as to the safety, completeness, accuracy, currency, usefulness, fitness for purpose, etc., of Restaurant Information or other posted information. When visiting a listed Restaurant, the User is strongly recommended to confirm directly with the Restaurant in advance, by telephone or other means. With respect to damage incurred by the User due to posted Restaurant Information, or trouble between Users, the Company shall be liable only where liability for default or in tort due to the Company's negligence is established, and only within the scope of ordinary actual damages that would normally arise (excluding lost profits and other damages arising from special circumstances). If any posted Restaurant Information is incorrect, please contact us.

（2）食のパスポートおよび摂取に関する事故 当社は、食のパスポートの作成・表示・提示、または当該パスポートを利用した飲食店等とのやりとりに関して、第9条に定めるとおりいかなる保証もいたしません。飲食物の摂取に起因する健康被害、アレルギー反応、疾患の発症・悪化、事故その他お客様または第三者に生じた損害について、当社の過失による債務不履行責任または不法行為責任が認められる場合のみ、当社は通常生ずべき実質損害（逸失利益その他特別の事情によって生じた損害を除きます）の範囲内でのみ損害賠償責任を負うものとします。

(2) The Food Passport and Accidents Related to Consumption As set out in Article 9, the Company makes no warranty whatsoever regarding the creation, display, or presentation of the Food Passport, or interactions with Restaurants or others using the Food Passport. With respect to health damage, allergic reactions, the onset or worsening of medical conditions, accidents, or any other damage to the User or third parties arising from the consumption of food or beverages, the Company shall be liable only where liability for default or in tort due to the Company's negligence is established, and only within the scope of ordinary actual damages that would normally arise (excluding lost profits and other damages arising from special circumstances).

（3）口コミの内容 当社は、掲載された口コミの内容に関していかなる保証もいたしません。お客様のご判断でご利用ください。掲載された口コミによって生じたお客様の損害（お客様が作成した各種コンテンツによるコンピュータ・ウィルス感染被害なども含みます）や、お客様同士のトラブル等について、当社の過失による債務不履行責任または不法行為責任が認められる場合のみ、当社は通常生ずべき実質損害（逸失利益その他特別の事情によって生じた損害を除きます）の範囲内でのみ損害賠償責任を負うものとします。

(3) Content of Reviews The Company makes no warranty whatsoever regarding the content of posted Reviews; please use them at your own judgment. With respect to damage incurred by the User due to posted Reviews (including, without limitation, computer virus infection caused by content created by Users) or trouble between Users, the Company shall be liable only where liability for default or in tort due to the Company's negligence is established, and only within the scope of ordinary actual damages that would normally arise (excluding lost profits and other damages arising from special circumstances).

（4）リンク先サイト 当社は、WE TABLE からリンクされた第三者が運営するサイト（Etsy等の外部プラットフォームを含みます。）に関して、何らの責任を負わず、いかなる保証もいたしません。お客様のご判断でご利用ください。リンク先のコンテンツ・広告・商品・サービス等に起因または関連して生じた損害、またはお客様同士のトラブル等に起因して生じた損害について、当社は何らの賠償責任を負わないものとします。

(4) Linked Sites The Company assumes no responsibility and makes no warranty regarding sites operated by third parties linked from WE TABLE (including external platforms such as Etsy); please use them at your own judgment. The Company shall bear no liability for damages arising from or related to the content, advertisements, products, or services of linked sites, or for damages arising from trouble between Users.

（5）口コミの削除 WE TABLE は、クルーによる自己責任に基づく口コミの投稿によって成り立っているコミュニティですが、多くのお客様に快適にご利用いただくため、以下に該当または類似すると当社が判断した口コミが発見された場合、当社の裁量により予告無く、当該口コミを WE TABLE 上から削除する場合があります。 ①本規約（特に第8条に定める投稿の遵守事項）に反するもの ②公序良俗に反するもの ③WE TABLE の趣旨、または口コミの対象となる飲食店と関係のないもの ④有害なプログラム・スクリプト等を含むもの ⑤営利を目的としたものや個人的な売買・譲渡を持ちかける内容、宣伝行為に関するもの ⑥その他、WE TABLE の管理運営を妨げる等、当社が不適切と判断したもの

(5) Deletion of Reviews WE TABLE is a community sustained by Reviews posted by the Crew at their own responsibility. To enable many Users to use it comfortably, if a Review that the Company determines to fall under or resemble any of the following is found, the Company may, at its discretion and without prior notice, delete such Review from WE TABLE. (i) Reviews that violate these Terms (in particular the posting compliance matters set out in Article 8); (ii) Reviews contrary to public order and morals; (iii) Reviews unrelated to the purpose of WE TABLE or to the Restaurant that is the subject of the Review; (iv) Reviews containing harmful programs, scripts, etc.; (v) Reviews for commercial purposes, soliciting private sale or transfer, or constituting advertising; (vi) Any other Reviews that the Company deems inappropriate, such as those that interfere with the administration of WE TABLE.

（6）地図情報 当社は、掲載された飲食店の所在地にかかる地図情報に関してはいかなる保証もいたしません。なお、地図情報は Mapbox, Inc. より提供され、同社が定める利用規約（Terms of Service）およびプライバシーポリシーが適用となります。

(6) Map Information The Company makes no warranty regarding the map information relating to the locations of listed Restaurants. The map information is provided by Mapbox, Inc., and the Terms of Service and Privacy Policy established by Mapbox, Inc. apply.

１.WE TABLE のサイトのデザイン、WE TABLE に含まれているコンテンツおよび個々の情報、商標、画像、広告、デザイン等（食のパスポートの表示テンプレート・翻訳文言・分類辞書を含みます。）に関する著作権、商標権その他の知的財産権、およびその他の財産権は全て当社または正当な権利者に帰属しています。

1. All copyrights, trademark rights, and other intellectual property rights, and other property rights, relating to the design of the WE TABLE site, the content and individual information contained in WE TABLE, trademarks, images, advertisements, designs, and the like (including the Food Passport's display templates, translated wording, and classification dictionaries), belong to the Company or to the rightful right holders.

２.WE TABLE および関連して使用されている全てのソフトウェアは、知的財産権に関する法令等により保護されている財産権を含んでいます。

2. WE TABLE and all software used in connection therewith include property rights protected by laws and regulations concerning intellectual property.

３.お客様は、当社もしくは著作権その他の知的財産権およびその他の財産権を有する第三者から利用・使用を許諾されている場合、または、法令により権利者からの許諾なく利用もしくは使用することを許容されている場合を除き、WE TABLE および WE TABLE の内容について複製、編集、改変、掲載、転載、公衆送信、配布、販売、提供、翻訳・翻案その他の利用または使用を行うことはできず、また第三者の利用に供することもできません。お客様は、ご自身の食のパスポートを、飲食店への提示・印刷等の本来の目的の範囲で利用できますが、表示テンプレート・翻訳文言等を複製し、競合サービス等に転用することはできません。

3. Except where licensed by the Company or by a third party holding the relevant copyrights or other intellectual property or property rights, or where use is permitted by law without the right holder's consent, the User may not reproduce, edit, modify, post, repost, publicly transmit, distribute, sell, provide, translate, adapt, or otherwise use WE TABLE or its contents, nor make them available for use by third parties. The User may use their own Food Passport for its intended purpose, such as showing it to Restaurants or printing it, but may not copy the display templates, translated wording, or the like for use in competing services.

４.お客様が前各項に反する行為によって被った損害については、当社は一切の責任を負わないものとします。また、お客様がこれらの行為によって利益を得た場合、当社はその利益相当額を請求できる権利を有するものとします。

4. The Company assumes no responsibility for any damage incurred by the User as a result of acts contrary to the preceding paragraphs. If the User obtains a profit through such acts, the Company shall have the right to claim an amount equivalent to such profit.

１.お客様が WE TABLE を利用するに際して、以下の行為を行うことを禁止します。

1. The User is prohibited from engaging in the following acts when using WE TABLE:

①法令上または本規約上特に認められている場合を除き、WE TABLE の提供する情報を当社の事前の同意なく、複写、若しくはその他の方法により再生、複製、送付、譲渡、頒布、配布、転売、またはこれらの目的で使用するために保管すること（PDF版の無断再配布・転売を含みます。）。 ②本規約に違反すること。 ③公序良俗に反すること。 ④違法行為・犯罪的行為・重大な危険行為に結びつくことまたはこれらを助長すること。 ⑤当社、他のお客様または第三者の知的財産権（著作権、意匠権、実用新案権、商標権、特許権、ノウハウを含みますがこれに限定されません）を侵害すること。 ⑥他のお客様または第三者の権利もしくは利益を違法に侵害し、またはそのおそれがあること。 ⑦WE TABLE の運営を妨げること、または当社の信用を毀損すること。 ⑧会員登録時に虚偽の申告をすること、または複数の会員登録を行うこと。 ⑨ログインアカウント等の不正使用または第三者に使用させること。 ⑩口コミの投稿時に、個人情報、お客様が秘密保持義務を有する機密情報、本来の利用目的に著しく反する情報、誹謗中傷や差別表現などの不適切な情報を入力すること。 ⑪WE TABLE サイトまたは当社に有害なコンピュータープログラム等を送信すること。 ⑫当社の事前の書面による同意なく、クローラー、スクレイピング、ボット、スパイダーその他の自動的な手段を用いて、本サービスの情報・コンテンツを収集、取得、複製、抽出または蓄積すること。 ⑬当社の事前の書面による同意なく、本サービスの情報・コンテンツ（口コミ、写真、飲食店情報、食のパスポートの表示テンプレート・翻訳文言等を含みます。）を、機械学習、人工知能（AI）その他の技術の学習用・開発用のデータセットとして利用、複製、提供または販売すること。 ⑭他人になりすます行為、または他人の食のパスポートを当該本人の許諾なく使用する行為。 ⑮その他、当社が不適切と判断すること。

(i) Except where specifically permitted by law or these Terms, copying, reproducing, sending, transferring, distributing, reselling, or storing for such purposes the information provided by WE TABLE without the Company's prior consent (including unauthorized redistribution or resale of the PDF Edition); (ii) Violating these Terms; (iii) Acting contrary to public order and morals; (iv) Acts that lead to or promote illegal acts, criminal acts, or seriously dangerous acts; (v) Infringing the intellectual property rights (including but not limited to copyrights, design rights, utility model rights, trademark rights, patent rights, and know-how) of the Company, other Users, or third parties; (vi) Unlawfully infringing, or risking infringement of, the rights or interests of other Users or third parties; (vii) Interfering with the operation of WE TABLE or damaging the Company's reputation; (viii) Making false statements at the time of member registration, or making multiple member registrations; (ix) Improperly using the Login Credentials or allowing a third party to use them; (x) Entering, when posting a Review, personal information, confidential information subject to a confidentiality obligation, information markedly contrary to the intended purpose of use, or inappropriate information such as defamation or discriminatory expressions; (xi) Transmitting computer programs or the like harmful to the WE TABLE site or the Company; (xii) Without the Company's prior written consent, collecting, acquiring, reproducing, extracting, or storing the information or content of the Service by means of crawlers, scraping, bots, spiders, or any other automated means; (xiii) Without the Company's prior written consent, using, reproducing, providing, or selling the information or content of the Service (including Reviews, photographs, Restaurant Information, and the Food Passport's display templates and translated wording, etc.) as a dataset for the training or development of machine learning, artificial intelligence (AI), or other technologies; (xiv) Impersonating another person, or using another person's Food Passport without that person's consent; (xv) Any other act the Company deems inappropriate.

２.お客様による前項各号に該当する行為または WE TABLE の趣旨・目的に照らして不適切であると当社が判断する行為がなされた場合、当社は当該お客様に対して、WE TABLE の利用停止その他当社が適切と判断する措置（以下「利用停止措置」といいます。）を催告なく直ちにとることができるものとします。なお、利用停止措置はお客様の帰責性の有無にかかわらず当社の裁量・判断に基づき行うことができるものとし、利用停止措置を行った理由については、お客様に対して一切お答えいたしかねます。また、利用停止措置に起因してお客様に生じた損害については、当社の過失による債務不履行責任または不法行為責任が認められる場合のみ、当社は通常生ずべき損害（逸失利益その他特別の事情によって生じた損害を除きます）の範囲内でのみ損害賠償責任を負うものとします。

2. If the User performs any act falling under the preceding paragraph, or any act the Company deems inappropriate in light of the purpose and objectives of WE TABLE, the Company may immediately and without notice take measures against that User, including suspension of use of WE TABLE or other measures the Company deems appropriate (the "Suspension Measures"). The Suspension Measures may be taken at the Company's discretion and judgment regardless of whether the User is at fault, and the Company will not answer any inquiries regarding the reasons for taking the Suspension Measures. With respect to damage incurred by the User arising from the Suspension Measures, the Company shall be liable only where liability for default or in tort due to the Company's negligence is established, and only within the scope of ordinary damages that would normally arise (excluding lost profits and other damages arising from special circumstances).

３.お客様その他の第三者が前項に定める禁止行為（特に第1項⑫および⑬に定める自動的な情報の収集・複製、人工知能の学習用データとしての利用等を含みます。）を行ったことにより当社に損害（システムへの過負荷もしくは障害対応に要する費用、機会の損失、信用の毀損その他一切の損害を含みます。）が生じた場合、当社は、当該行為を行った者に対し、その損害の賠償を請求することができるものとします。

3. If the Company suffers damage (including, without limitation, costs of dealing with system overload or failures, loss of opportunity, damage to reputation, and any and all other damage) as a result of a User or any other third party engaging in a prohibited act set out in the preceding paragraph (in particular, the automated collection or reproduction of information, or use as training data for artificial intelligence, set out in items (xii) and (xiii) of paragraph 1), the Company may claim compensation for such damage from the person who performed the act.

１.会員が退会を希望する場合は、当社の所定の退会手続を行うものとします。退会手続を行うと、保存された食のパスポートおよびお客様を特定できる個人データ（これに関連して入力された健康・食事制限に関する情報を含みます。）を遅滞なく削除し、又は特定の個人を識別できない形に加工します。当社が特定の個人を識別できない形に加工した情報（統計データ、匿名加工情報等をいいます。）は、削除の対象外とし、当社はプライバシーポリシー5.（個人情報の利用目的）の範囲でこれを引き続き利用できるものとします。加工の具体的な方法は当社が定めるものとします。詳細はプライバシーポリシーによります。

1. A Member who wishes to withdraw shall follow the withdrawal procedures prescribed by the Company. Upon completion of the withdrawal procedures, the Company will, without undue delay, delete or process into a form that cannot identify a specific individual the saved Food Passport and the personal data that can identify the User (including the health/dietary-restriction information entered in connection with it). Information that the Company processes into a form that cannot identify a specific individual (such as statistical data or anonymized information) is not subject to deletion, and the Company may continue to use it within the scope of the Purposes of Use in Section 5 of the Privacy Policy. The specific method of such processing shall be determined by the Company. Details are as set out in the Privacy Policy.

２.会員は、退会手続を行った場合、当社でご利用いただいていたアカウントに関する一切の権利、特典を失うものとします。

2. Upon completing the withdrawal procedures, the Member loses all rights and benefits relating to the account used with the Company.

３.会員は、退会手続を行った後も、自らが投稿した口コミその他の投稿の全部又は一部が、当社において引き続き保持又は利用される場合があることを、予め承諾するものとします。

3. The Member acknowledges in advance that, even after completing the withdrawal procedures, all or part of the Reviews and other content they have posted may continue to be retained or used by the Company.

４.会員が退会手続を完了した場合、または当社と会員との間の本規約に基づく契約が終了した場合であっても、第3条、第5条、第8条、第9条、第10条、第11条、第12条、第15条、第16条は、なお有効とします。

4. Even after the Member completes the withdrawal procedures, or the contract between the Company and the Member based on these Terms terminates, Articles 3, 5, 8, 9, 10, 11, 12, 15, and 16 shall remain in effect.

１.本規約は、民法第548条の4に定める定型約款に該当します。当社は、同条の定めに従い、本規約を変更できるものとし、当社が任意に定めた効力発生日から変更後の本規約の効力が発生するものとします。

1. These Terms constitute standard terms of contract (teikei yakkan) under Article 548-4 of the Civil Code. In accordance with that Article, the Company may change these Terms, and the amended Terms take effect from the effective date determined by the Company.

２.前項の場合、当社は、効力発生日の30日以上前の相当な時期までに、お客様に対して、本規約の変更の内容および効力発生日を WE TABLE サイトにおいて通知いたします。ただし、当該変更によるお客様の不利益の程度が軽微であると当社が判断した場合、その期間を短縮することができるものとします。

2. In the foregoing case, the Company will notify Users of the content of the change and the effective date on the WE TABLE site by a reasonable time at least 30 days before the effective date. However, if the Company determines that the degree of disadvantage to Users from the change is minor, the Company may shorten that period.

３.前項の規定は、本規約の変更がお客様の一般の利益に適合する場合には適用しないものとします。

3. The preceding paragraph does not apply where the change to these Terms conforms to the general interest of Users.

４.免責の範囲、健康・食事制限に関する情報の取扱い、または有償化に関する重要な変更を行う場合、当社は、施行後の初回ログイン時等に変更内容の要約を表示し、お客様の再同意を取得することがあります。この場合、再同意が得られるまで、食のパスポートの新規作成・編集をご利用いただけないことがあります（閲覧は可能です）。

4. Where the Company makes an important change concerning the scope of disclaimers, the handling of health/dietary-restriction information, or the introduction of fees, the Company may display a summary of the change (for example, at the first login after it takes effect) and obtain the User's re-consent. In such a case, the creation or editing of a Food Passport may be unavailable until re-consent is obtained (viewing remains possible).

本規約は日本語を正文とします。当社は、お客様の便宜のために本規約の英語版その他の言語による翻訳を提供することがありますが、これらは参考訳であり、日本語版と翻訳との間に齟齬または解釈の相違がある場合には、日本語版が優先して適用されるものとします。本規約に関連して当社が提供するプライバシーポリシー、食のパスポートに係る表示・翻訳その他の文言についても、同様に日本語版を正文とします。

The official version of these Terms is the Japanese version. For the User's convenience, the Company may provide translations of these Terms into English or other languages; such translations are reference translations only, and in the event of any discrepancy or difference in interpretation between the Japanese version and a translation, the Japanese version shall prevail. The same applies to the Privacy Policy and the displays, translations, and other wording relating to the Food Passport that the Company provides in connection with these Terms: the Japanese version is the official version.

本規約は、日本法に基づき解釈されるものとし、本規約に係る一切の紛争は、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

These Terms shall be construed in accordance with the laws of Japan, and the Tokyo District Court shall be the court of exclusive agreed jurisdiction in the first instance for any and all disputes relating to these Terms.
